Zoning Ordinance

A new zoning ordinance was adopted by City Council on November 28, 2007 and became effective on December 27, 2007.

The new Zoning Ordinance is an organizational improvement from the existing code. It was the intent of the re-write to make the ordinance more user friendly to the public and to the different professionals that rely on these regulations to conduct their business activities. The new ordinance is organized with a table of contents and 15 individual articles with an appendix at the end.

Subdivision Regulations

New regulations for new subdivisions were approved by the Planning Commission and became effective February 18, 2005.

The changes bring the rules up to date with development trends over the past 25 years. They were drafted with input from developers, homebuilders, attorneys and other interested citizens.

Major changes to the regulations include:

• Clarification that the Subdivision Regulations are enforced over Covenants.
• A provision was added that a developer must establish a Property Owners Association with all new plats.
• Added a provision that clarifies the powers and duties of the Planning Commission and City Council.
• Added a provision that clarifies the powers and duties of the Planning Director, Public Works Director and the Water/Waste Water Director.
• Changed the provision to allow the Planning Director to sign new plats in place of the Planning Commission Chairman.
• Established criteria for administrative amendments to Preliminary and Final Plats.
• Establishes criteria for naming streets, easement dedications, and placing gates on private streets.

A section of the subdivision regulations were reserved to allow for Traditional Neighborhood standards to be included at the time of development of a new Traditional Neighborhood district with the pending zoning ordinance amendment.
