The meeting of the Oklahoma City Historic Preservation Commission was called to order in the City Council Chamber, 3rd Floor of the Municipal Building, 200 N. Walker Avenue, Oklahoma City, Oklahoma.  The meeting convened at 3:13 p.m.  Notice of the meeting and agenda were filed with the City Clerk’s office and posted on the Council bulletin board 24 hours prior to the meeting.

1.         CALL TO ORDER AND ROLL CALL

2.            APPROVAL OF MINUTES

APPROVED.  Motion:  Galbraith/Holcombe to approve the minutes of the March 3, 2004 Historic Preservation Commission meeting.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

3.            CITATION REPORT

                        Mr. Wilson, Zoning Inspector, was present to comment.

4.            CONTINUANCE REQUESTS

A. Staff request continuance of the following cases:

            6.A.     HPCA-03-048 at 2600-2606 N Shartel Street. (Paseo HD), Ward 2.  (Recommended for continuance) Consideration and possible action on application of Mike Assef for Certificate of Appropriateness HPCA-03-048 to 1.) remove 1 steel overhead garage doors, 2.) install 1 wood panel overhead garage door with wood pedestrian door insert. 

Mr. Assef was not present.

CONTINUED.  Motion:  Taylor/Couch to approve continuance of application HPCA-03-048 until the May 5th meeting to allow the applicant additional time to supply the necessary documentation for the proposed garage door replacement.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            B.            Other continuance requests:  None.

5.            CONSENT DOCKET CASES

            A.        HPCA-03-019 at 204 NW 32 Street. (Edgemere Park HD), Ward 2.  Consideration and possible action on application of John Franks for Certificate of Appropriateness to extend the expiration date of the previously approved application to 1.) re-pour all original concrete, 2.) widen driveway to 10', 3.) construct garage on original garage location, 4.) move existing brick landscape wall to edge of drive and reduce its size, 5.) remove existing chain link fences, and install 2 decorative iron gates.

Mr. Franks was not present.

CONTINUED.  Motion:  Bennett/Couch to continue application HPCA-03-019 until the May 5th meeting, allowing the applicant to provide information indicating the length of the requested extension, the items requiring additional time to be complete and reason for the requested extension.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

6.            CASES FOR INDIVIDUAL CONSIDERATION

            A.        HPCA-03-048 at 2600-2606 N Shartel Street. (Paseo HD), Ward 2.  (Recommended for continuance) Consideration and possible action on application of Mike Assef for Certificate of Appropriateness HPCA-03-048 to 1.) remove 1 steel overhead garage doors, 2.) install 1 wood panel overhead garage door with wood pedestrian door insert. 

APPROVED FOR CONTINUANCE WITHOUT DISCUSSION.  See motion at agenda section 4.A.

            B.        HPCA-04-027 at 2115 NW 25 Street. (Shepherd HD), Ward 2.  Consideration and possible action on application of Terry Craft for Certificate of Appropriateness to 1.) replace fascia at porch and carport with wood trim to match house, 2.) incase decorative iron columns at front porch and carport in wood to create 12” square columns, 3.) construct new front porch rail and 4.) remove paint from stone. 

Mr. Craft was present.

APPROVED.  Motion:  Bennett/Couch to approve application HPCA-04-027, while strongly encouraging the applicant to consider removal of the non-historic carport and front porch at a future date.  Ayes:  Bennett, Couch, Taylor, Holcombe, Small.  Nays:  Galbraith.

            C.        HPCA-04-032 at 2224 NW 29 Street. (Shepherd HD), Ward 2.  Consideration and possible action on application of Victor Valle for Certificate of Appropriateness to 1.) remove existing metal shed and 2.) construct shed. 

Mr. and Mrs. Valle were present and agreed to amend the shed proposal to include a one over one wood window, wood panel doors, and horizontal lap siding of wood or smooth HardiPlank with wood corner boards and wood trim. The applicant agreed with the Commission’s opinion that the shed should be placed at least 3 feet away from the fences.  The applicant clarified that the roof was a 6-12 pitch.  New drawings indicating the amendments will be submitted to staff prior to release of CA.

CONDITIONALLY APPROVED.  Motion:  Bennett/Couch to approve application HPCA-04-032 contingent upon the installation of one over one wood window/windows, use of wood panel doors, and the use of horizontal wood lap siding with wood corner boards and wood trim, as amended by the applicant.  New drawings indicating the amendments must be submitted to staff prior to release of CA.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            D.        HPCA-04-002 at 101 NW 21 Street. (Heritage Hills East HD), Ward 7.  Consideration and possible action on application of Jim Riley for Dick Liddell for Certificate of Appropriateness to 2.) replace front porch railing, 3.) install tongue and groove floor and 4.) install porch skirt. 

Mr. Pellow and Mr. Pruit were present.

APPROVED.  Motion:  Taylor/Holcombe to approve application HPCA-04-002.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            E.         HPCA-04-003 at 105 NW 21 Street. (Heritage Hills East HD), Ward 7.  Consideration and possible action on application of Jim Riley for Dick Liddell for Certificate of Appropriateness to 2.) replace front porch railing. 

Mr. Pellow and Mr. Pruit were present.

APPROVED.  Motion:  Taylor/Holcombe to approve application HPCA-04-002.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            F.         HPCA-04-035 at 315 NW 19 Street. (Heritage Hills HD), Ward 6.  Consideration and possible action on application of Philip Stenseth for Certificate of Appropriateness to 1.) alter existing fence by adding decorative element at top to create an 8’ fence and 2.) construct additional panels as necessary to complete the fence. 

Mr. Stenseth was present

DENIED WITHOUT PREJUDICE.  Motion:  Taylor/Bennett to deny application HPCA-04-035 as insufficient evidence currently exists of any “unique circumstances” that would over ride the recently adopted Ordinance/design guidelines.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            G.        HPCA-03-123 at 900 NW 19 Street. (Mesta Park HD), Ward 6.  Consideration and possible action on application of Janice McClain for Certificate of Appropriateness to remove asphalt shingles at the garage and install metal tile roof to match clay tile on house. 

Ms. McClain was not present.

DENIED WITHOUT PREJUDICE.  Motion:  Bennett/Couch to deny application HPCA-03-123 due to lack of information.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            H.        HPCA-04-037 at 920 NW 17 Street. (Mesta Park HD), Ward 6.  Consideration and possible action on application of Michael Casey for Certificate of Appropriateness to 1.) close one back window, 2.) install one new window in a different back window opening that has been closed, 3.) construct new addition at back corner of house, 4.) open back wall between existing kitchen and the new addition, 5.) add French doors, and 6.) replace siding. 

Mr. Casey was present.  He agreed to amend the proposal to replace the existing back façade window in-kind.

APPROVED AS AMENDED.  Motion:  Galbraith/Holcombe to approve Item 1 of application HPCA-04-037 as amended to replace the existing window in-kind.    Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

APPROVED AS AMENDED.  Motion:  Galbraith/Couch to approve Item 2 of application HPCA-04-037 as amended to include the installation of a window that will be slightly smaller than the original opening.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

APPROVED AS AMENDED.  Motion:  Holcombe/Bennett to approve Item 3 of application HPCA-04-037 contingent upon the drawings to be noted that walls will be set back at least 6” from the adjacent wall.    Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

APPROVED.  Motion:  Galbraith/Couch to approve Item 4 of application HPCA-04-037.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

APPROVED.  Motion:  Galbraith/Couch to approve Item 5 of application HPCA-04-037.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

APPROVED.  Motion:  Holcombe/Taylor to approve Item 6 of application HPCA-04-037 contingent upon the use of wood siding that matches the exposure of existing wood siding in like locations where new siding is required.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            I.          HPCA-04-033 at 509 NW 20 Street. (Mesta Park HD), Ward 6.  Consideration and possible action on application of Byron Chatterton for Certificate of Appropriateness to 1.) enlarge existing shared driveway. 

Mr. Chatterton was present and indicated that after further review of the situation he has decided to remove the added portions of concrete.  Those portions will be saw cut and removed.  The remaining portions of new concrete are repair of the original.  Mr. Chatterton withdrew his application, and no action is required by the Commission.

NO ACTION REQUIRED – APPLICATION WITHDRAWN. 

            J.         HPCA-04-030 at 1001 NW 21 Street. (Mesta Park HD), Ward 6.  Consideration and possible action on application of Michael Khoury for Certificate of Appropriateness to 1.) install new front door.

Mr. Khoury was present and indicated that the proposed door matches the previously existing door.

APPROVED.  Motion:  Bennett/Holcombe to approve application HPCA-04-030.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            K.        HPCA-04-028 at 911 NW 19 Street. (Mesta Park HD), Ward 6.  Receive the actions of the Fire Marshal to declare the structure a threat to public safety and order the issuance of a demolition permit concerning the application of Young Shin for Certificate of Appropriateness HPCA-04-028 to 1.) demolish burned structure. 

NO ACTION was taken.

            L.         HPCA-04-015 at 2912 The Paseo Street. (Paseo HD), Ward 2.  Consideration and possible action on application of Paseo Village for Certificate of Appropriateness to 1.) add cantilever balcony to second floor, 2.) create new building entry with balcony above, 3.) create roof balcony  and 4.) install awnings. 

Mr. Belt was present.

CONDITIONALLY APPROVED.  Motion:  Bennett/Galbraith to approve application HPCA-04-015 contingent on the applicant confirming staff notes written on the drawings by initialing the drawings.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

            M.       HPCA-04-013 at 2612 N Hudson Street. (Jefferson Park HD), Ward 2.  Consideration and possible action on application of Loren Capron for JP Neighborhood Association CHDO for Certificate of Appropriateness to 1.) install wood capped fence not to exceed 6’ in height. 

Mr. Capron was present.

APPROVED.  Motion:  Galbraith/Bennett to approve application HPCA-04-013 with Option B and with the south fence side not to extend further west than the front column of the front porch.  Approval of non-compliant location of fence based on “unique circumstances” of a multi-family dwelling abutting a single-family dwelling.  Ayes:  Galbraith, Bennett, Couch, Holcombe, Small.  Nays:  Taylor.

            N.        HPCA-04-005 at 116 NW 26 Street. (Jefferson Park HD), Ward 2.  Consideration and possible action on application of Tony Thongkham for Certificate of Appropriateness to 2.) construct garage. 

Mr. Thongkham was present.

PARTIALLY APPROVED PARTIALLY CONTINUED.  Motion:  Galbraith/Taylor to approve construction of the garage and continue the driveway.  Ayes:  Galbraith, Bennett, Couch, Taylor, Holcombe, Small.  Nays:  None.

                        Commissioner Taylor excused herself due to prior commitment.

            O.        HPCA-04-029 at 240 NW 34 Street. (Edgemere Park HD), Ward 2.  Consideration and possible action on application of James Martin for Certificate of Appropriateness to 1.) replace side dooor with a window and remove steps, 2.) add divided light (15 lights) back door and  3.) replace wood deck at back of house.

Mr. Martin was present. 

APPROVED.  Motion:  Galbraith/Couch to approve Item 2 of application HPCA-04-029.  Ayes:  Galbraith, Bennett, Couch, Holcombe, Small.  Nays:  None.

APPROVED.  Motion:  Bennett/Couch to approve Item 3 application HPCA-04-029 for a new concrete patio.  Ayes:  Galbraith, Bennett, Couch, Holcombe, Small.  Nays:  None.

DENIED WITH PREJUDICE.  Motion:  Galbraith/Holcombe to deny Item 1 of application HPCA-04-029 as the rear side entry is a significant character defining feature in this neighborhood. Ayes:  Galbraith, Holcombe, Small.  Nays:  Bennett and Couch.

7.            OTHER BUSINESS

A. Consideration and possible recommendation on the Preservation Review Committee’s policy and procedures.

                        NO ACTION was taken on this draft.

Gary Wood, Crown Heights Neighborhood Association representative commented. Raina Pelofsky, Mesta Park Neighborhood Association representative was also present.

8.            COMMUNICATIONS

A.            Administrative Approval Report.

            B. The application for Certificate of Appropriateness of Richard Carlson (Mesta Park) will be amended and presented to the Commission at the May 2004 meeting.  Corrections will be made to the eave at new dormer as approved.  However,  a revised work schedule will be presented.  The fence proposal has been withdrawn as the completion date has expired on this item.

            C. Todd Ranger (Crown Heights HD) submitted an appeal to the Board of Adjustment.  The appeal was heard by BOA at the April 2, 2004 meeting.

D.       HPCA-02-092 at 2908 N. Shartel. (Paseo HD), Ward 2.  The property owner,                 Themistoklis Politis, was issued a citation for inappropriate completed work.  The           case was heard at the Municipal Criminal Court, 700 Couch Drive on April 5, 2004       at  8:30am.

THE ANNOUNCEMENT WAS MADE THAT THIS COURT DATE WAS POSTPONED.

            E.             F. Announcing the Wood Window Restoration Workshop on May 29- June 5, 2004.  This workshop is presented by Heritage Conservation Network, in association with Historic Fort Reno and the Oklahoma State Historic Preservation Office, and will be led by Simon Herbert.  Participants will get hands on experience with the techniques presented by helping to restore an 1890s stone guardhouse.
